Terms & Conditions
These Terms and Conditions (“Terms”) govern the provision of services by Warri Bagurrk, an
Aboriginal-owned business based in Victoria, Australia. By engaging Warri Bagurrk to deliver
weaving workshops or related services, you (“the Client”) agree to be bound by the following Terms.
1. Bookings and Payment
- All bookings are confirmed once full payment has been received, unless otherwise agreed in
writing.
- Payment must be made in full prior to the commencement of any workshop.
- For approved corporate clients with ongoing engagements, credit terms may be considered at
Warri Bagurrk’s discretion.
2. Invoicing and Late Fees
- Invoices must be paid by the due date specified.
- If payment is not received after a reminder has been issued, Warri Bagurrk reserves the right to
apply a late fee to cover additional administrative costs.
3. Cancellations and Refunds
- Client Cancellation: If a Client cancels more than 48 hours prior to the scheduled workshop, a
50% refund may be issued. Cancellations made within 48 hours of the workshop will not be eligible
for a refund.
- Facilitator Cancellation: If Warri Bagurrk cancels due to unforeseen circumstances, a
rescheduled date will be offered at the next available opportunity. If rescheduling is not possible, a
refund may be provided at Warri Bagurrk’s discretion.
4. Service Delivery
- Warri Bagurrk will provide workshops with due care, cultural integrity, and professionalism.
- Clients are responsible for ensuring that an appropriate and safe space is provided for workshops,
including adequate seating, tables, and accessibility.
- Warri Bagurrk is not liable for any personal injury, loss, or damage sustained by participants
during workshops, except where required by law.
5. Intellectual and Cultural Property
- All cultural knowledge, weaving techniques, and materials shared during workshops remain the
intellectual and cultural property of Warri Bagurrk.
- Clients and participants must not record, reproduce, or distribute workshop content without prior
written consent.
- Workshops are intended for educational and cultural awareness purposes only and must not be
used for commercial replication.
6. Website and Online Content
- While care is taken, Warri Bagurrk accepts no responsibility for the use of its website or for any
errors, omissions, or inaccuracies in online content.
- External links provided on the website are for convenience only and do not constitute
endorsement.
7. Confidentiality
- Any confidential information disclosed by either party during the course of the engagement will
remain strictly confidential and must not be shared without prior written consent, except where
required by law.
8. Force Majeure
- Warri Bagurrk shall not be held responsible for delays, cancellations, or non-performance of
services due to circumstances beyond its reasonable control, including but not limited to natural
disasters, pandemics, or government restrictions.
9. Insurance
- Warri Bagurrk maintains public liability insurance to ensure coverage for its services. Proof of
insurance can be provided upon request.
10. Code of Conduct
- Clients and participants are expected to behave respectfully towards the facilitator and the cultural
practices being shared.
- Warri Bagurrk reserves the right to remove any participant from a workshop if their behaviour is
disruptive or disrespectful.
11. Consumer Rights
- Nothing in these Terms is intended to exclude, restrict, or modify your rights under the Australian
Consumer Law (ACL) or other applicable State or Territory laws.
12. Governing Law
- These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these
Terms shall be subject to the exclusive jurisdiction of the courts
